Terms and Conditions

These Terms and Conditions apply to all services, commissions, and purchases made through Artsélily Covers.

In these Terms, “the Designer” refers to Artsélily Covers, and “the Client” refers to any individual or entity purchasing or commissioning a design. By commissioning or purchasing a design, the Client acknowledges that they have read, understood, and agreed these Terms and Conditions.

Quick Reference

Payment No deposit is required. Payment is only requested after the Client approves the preview. Full payment must be completed before final files are released.

Ownership The Designer retains copyright of all designs. The Client receives a license to use the final design for the specific project it was created for. Stock assets are third-party licensed.
Final Files Delivered via email and Google Drive in publishing-ready formats (JPEG, PNG, PDF). Source files are not included. The Client is responsible for backup and proper use.
Cancellation If a custom commission is cancelled after completion or left unpaid, the Designer may convert the design into a premade cover and sell it to other clients.

1. Services

1.1 The Designer provides book cover design services for publishing and promotional use. Services may include ebook covers, paperback covers, hardcover covers, audiobook covers, and promotional graphics.

1.2 The exact formats provided depend on the package or service purchased. Additional formats or promotional graphics requested may require additional fees.

1.3 The Designer retains the right, at their sole discretion, to decline or cancel any commission at any time as they see fit.

2. Pricing

2.1 All listed prices represent base rates. The final price may vary depending on the project scope, requested formats, and complexity.

2.2 If the Client requests rush order, additional formats, major revisions, or design changes that significantly alter the scope of the project, the price may be adjusted. The Client will always be informed before additional costs are applied.

2.3 The Designer may maintain different pricing structures for Filipino and international clients to account for cost of living, currency exchange, and payment fees.

2.4 Cover prices, add-ons fees, and packages may change at any time for future orders.

3. Payment Policy

3.1 No down payment is required. Payment is only requested after the Client approves the preview design and is ready for delivery.

3.2 Once the Client approves the preview, the design is considered accepted for finalization.

3.3 Full payment must be completed immediately or within 3 business days of approval. Final files will only be delivered after payment is received.

3.4 All completed and delivered work is non-refundable.

3.5 The Designer reserves the right to refuse future services to clients who fail to complete payment.

3.6 Abandoned Projects
If the Client becomes unresponsive for more than 14 days, the project may be considered abandoned. The Designer may cancel the project and repurpose any completed work, including converting the design into a premade cover.

4. Payment Methods

4.1 Payments from Filipino clients are accepted through GCash, Maya, and GoTyme.

4.2 International clients may send payments through PayPal or Payoneer.

5. Turnaround Time

5.1 Turnaround times are estimates and are not guaranteed. They may vary depending on the complexity of the project, the number of revisions requested, the current workload, and the responsiveness of the Client during the design process.

5.2 Custom covers are typically completed within five (5) to ten (10) business days, depending on scheduling and project complexity. Premade covers are usually delivered within one (1) to three (3) days after purchase once the necessary information has been provided.

5.3 Rush Commissions
Rush commissions may be accommodated at the Designer's discretion and subject to availability. Applicable rates and timeframes are shown in the table above. Orders with a rush request are given priority in the processing queue.

5.4 Delay Compensation
If the Designer becomes unreachable and fails to communicate about delays for one full month, the Client may choose either:

  • Continue with the project and receive a 50% discount on the base cover price only as compensation for the delay. Any add-ons, such as major revisions, additional graphics, or rush fees, are not included in this discount; or
  • Cancel the project with no further obligation.

6. Delivery of Final Files

6.1 Final cover files are delivered without watermarks via email and Google Drive.

6.2 Files are delivered in publishing-ready formats. Source files are not included.

  • ❌ PSD or other layered/source files — not included and will not be distributed

6.3 File Use
Once the final files are approved and delivered, the Client assumes full responsibility for their use. The Client must review all files for defects or errors before use or publication and is strongly encouraged to request a physical or digital proof from the printer to confirm color accuracy, dimensions, and print quality. The Designer is not responsible for printing errors or technical issues caused by third-party services such as printers, publishing platforms, or distributors.

6.4 Raw Assets
The Client does not receive any raw or individual stock assets, fonts, or design resources used in the creation of the design. Only the final composed design files are delivered.

7. Revisions

7.1 Minor Revisions
Minor revisions may include:

  • text placement adjustments
  • color changes
  • font changes
  • small layout refinements

Unlimited minor revisions are allowed within the scope of the original design concept during the active design process only — before final files are delivered.

7.2 Major Revisions
Changes that significantly alter the design concept may incur an additional fee, depending on complexity, of up to 50% or more of the base cover price, with each charge covering up to two (2) revision rounds.

7.3 Post-Delivery Revisions
After final delivery, any additional revisions will be charged at 50% of the base cover price, with each charge covering up to two (2) revision rounds, and may be adjusted depending on the complexity of the request.

8. Premade Cover Policy

8.1 Once a premade cover is purchased and paid for, it becomes exclusive to that Client.

8.2 Premade covers may be reserved for a maximum of three (3) days. If payment is not completed within the reservation period, the cover will automatically be relisted on the website and made available for purchase again.

8.3 For commissioned covers, if the Client cancels the project or fails to complete the required payment within the agreed timeframe after the design is finished, the Designer reserves the right to convert the design into a premade cover and list it for sale to other clients at any time.

10. Usage & Stock Rights

This section covers the usage license granted to the Client upon full payment and the policies governing third-party resources used in the design.

10.1 Usage Rights
Upon full payment, the Client is granted a non-exclusive license to use the final design only for the specific book project and format(s) purchased.

Example: If the Client purchased the cover for eBook only, the license applies only to eBook publishing.

Any future use in a different format (paperback, hardcover, promotional materials not included in the order) requires the Client to contact the Designer and obtain a separate license.

The license allows commercial use for the book project in licensed formats, subject to third-party stock licensing limits where applicable, including:

  • eBook, paperback, hardcover, and audiobook covers (licensed formats only)
  • Websites and landing pages
  • Social media and promotional materials
  • Printed marketing materials related to the book
  • Any approved add-on items (e.g., bookmarks, postcards, flyers)

❌ The design may not be reused, modified, or adapted for other books, sequels, merchandise, or unrelated commercial products without prior permission.

10.2 Stock Assets & Design Resources
The design may include images, fonts, textures, graphics, mockups, or other elements sourced from third-party paid or hybrid providers, including but not limited to:

For assets sourced from Depositphotos, usage is limited to 500,000 copies under the standard license. For distribution beyond 500,000 copies, an extended license must be availed.

For assets sourced from Canva Pro, Envato Elements, and Freepik, there are no limitations on digital and print copies for use within the final delivered design, based on their standard license terms.

All such assets are:
• Legally licensed by the Designer for use in the specific project
• Used in accordance with the license terms at the time of download or use

The Client is granted the right to use these assets only as part of the final delivered design.

The Client may not:
Extract, reuse, redistribute, or resell any individual stock asset
• Use the assets separately for other projects
• Claim ownership of any third-party materials

If the Client wishes to use any stock asset beyond the final design, a separate license must be obtained directly from the original provider.

10.3 License Certificates & Proof of Use
Some platforms (e.g., Envato Elements, Depositphotos, and certain Freepik assets) provide downloadable license certificates or proof of licensing.

Other platforms (e.g., some Canva Pro assets and selected Freepik assets) may not issue formal certificates but still allow use under their license terms and account records.

Upon request, the Designer may provide available proof of licensing, including certificates, download records, or reference links where applicable.

⚠️ Providing such proof does not transfer ownership or licensing rights of the assets to the Client. The Client is responsible for ensuring that any use of the final design complies with:
• The scope of use granted in this agreement
• The applicable licensing terms of the original asset providers

10.4 Third-Party Disclaimer
All stock assets remain the property of their respective owners and are subject to their individual licensing terms.

While the Designer ensures all assets are properly licensed at the time of use, the Designer cannot guarantee that third-party licensing terms will remain unchanged or free from future disputes.

The Designer shall not be held liable for issues arising from:
• Unauthorized or improper use of the design by the Client
• Use of the design outside the agreed scope
• Licensing violations caused by third-party actions or changes in licensing terms

In the event of a legitimate licensing concern, the Designer may, at their discretion, assist in replacing the affected asset within the design where reasonably possible.

11. AI Usage Policy

11.1 The Designer does not intentionally use AI-generated elements in its designs. However, some stock platforms may contain AI-generated materials that are not clearly labeled.

11.2 If any asset used in a design is later discovered to contain undisclosed AI-generated content, the Designer will revise the design or replace the element at no additional cost.

12. Client Responsibilities

12.1 The Client must provide accurate and complete information required to complete the project. Incorrect or incomplete information may result in delays, additional revision fees, or unsatisfactory design outcomes. The Client must carefully review the cover design before final approval and ensure all text, spelling, images, sizes, colors, and etc. are correct. The Designer is not responsible for errors caused by inaccurate information provided by the Client or issues not reported during the preview stage.

12.2 If the Client provides images, graphics, logos, or other materials, the Client is responsible for ensuring they are legally owned or properly licensed and must provide proof of ownership or licensing if requested.

12.3 The Designer is not responsible for any legal disputes or copyright claims arising from materials supplied by the Client.

13. Data Storage

13.1 The Designer may temporarily store completed project files after delivery for backup purposes, but files are kept for a maximum of one (1) year after project completion.

13.2 After this period, the Designer may permanently delete archived files to free up storage space. The Client is strongly advised to download their files upon delivery and maintain their own backups, as the Designer cannot recover files once the storage period has expired.

14. Limitation of Liability

14.1 The Designer is not responsible for financial losses, printing errors, platform issues, sales performance, or any other problems that occur after the final design files have been delivered and approved, including issues related to publishing platforms or book distribution services.

14.2 The Designer’s maximum liability is limited to the total amount paid by the Client for the design service.

15. Privacy Policy

15.1 The Designer respects the privacy of its clients. Any personal information shared during the commission process will remain confidential and will not be shared with third parties unless required by law or necessary to complete the service.

16. Credit

Credit to the Designer is greatly appreciated when the cover design is used. When giving credit, the Client may include an attribution in the book—such as on the back cover, copyright page, or another suitable location—in a format like "Cover design © Artsélily Covers", or simply tag us on Facebook or other social media platforms.

17. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to remain in full effect.

18. Dispute Resolution

The Designer values open and respectful communication with all clients. Any disagreement or concern should first be addressed through direct discussion.
